Terms & Conditions

1. Acceptance of Terms

By accessing or using Epitaphy (“the Service”), you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the Service.

2. Service Description

Epitaphy provides AI-assisted obituary drafting services. Drafts are generated using artificial intelligence and reviewed through structured quality controls. During Phase 1 operations, all orders require manual founder approval prior to delivery.

We are not a funeral home, legal advisor, clergy service, grief counselor, or publishing authority. We do not guarantee publication acceptance by any third party.

3. AI Disclosure & Proofreading Requirement

Drafts are generated based solely on the information you provide. While validation safeguards are in place, AI systems can make errors.

You are solely responsible for reviewing and approving all content before publication. Epitaphy is not liable for errors that are not corrected prior to publication.

4. User Responsibilities

You agree to provide accurate and complete information and confirm you have the legal right to share all submitted content. You may not submit unlawful, defamatory, infringing, or fraudulent material or impersonate another person.

5. Turnaround Times

Delivery estimates are provided at checkout and are not guaranteed. Timing may be affected by volume, technical interruptions, or third-party provider delays.d.

6. Revisions

Revision availability depends on the service tier selected. Revisions must be based on originally submitted information. Substantial new facts may require a new order.

7. Payments & Refunds

Payment is required in full before processing begins. Payments are handled by secure third-party processors.

Refunds may be granted for non-delivery or material deviation from submitted facts caused by Epitaphy. Requests must be submitted within 7 days of delivery.

Refunds are not issued for stylistic preference disagreements, publication rejection, or change of mind.

8. Intellectual Property

Upon full payment, you may use and publish the delivered obituary. Epitaphy may use anonymized excerpts for internal quality improvement unless you request otherwise in writing.

9. Privacy & Data Retention

We retain order data for approximately 30 days after delivery to allow for support. After this period, sensitive information may be deleted or anonymized.

You may request earlier deletion.

10. Third-Party Processors

We use third-party providers for AI processing, workflow automation, payments, and email delivery. Data is transmitted solely to deliver the Service and is not sold.

11. Limitation of Liability

To the fullest extent permitted by law, Epitaphy is not liable for indirect, incidental, or consequential damages.

Total liability shall not exceed the amount paid for the specific order giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Epitaphy from claims arising from your submitted content or misrepresentation of facts.

13. Service Availability & Force Majeure

We do not guarantee uninterrupted service. We are not responsible for delays or failures caused by events beyond our reasonable control.

14. Governing Law

These Terms are governed by the laws of the State of Massachusetts, without regard to conflict of law principles.

15. Arbitration & Class Action Waiver

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration in the State of Massachusetts, rather than in court, except that either party may bring claims in small claims court if eligible.

You agree that disputes will be conducted on an individual basis only and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or otherwise preside over any form of representative or class proceeding.

16. Modifications to Terms

We may update these Terms at any time. The current version will always be posted on our website.
